Recovery of Off-Plan Deposits

Spanish case law now enables buyers to claim back payments made for off-plan properties that were not built, delivered late, or lacked the required Occupancy Permit.

A major precedent

A landmark decision of the Spanish Supreme Court (21 December 2015) shifted liability to financial institutions, allowing buyers to seek a refund of all sums paid plus interest.

Key points for a successful claim

  • You may file a legal claim directly against the financial institution.
  • The bank can be liable even if guarantees were not provided or the developer is insolvent.
  • You do not need to claim against the developer first.
  • A claim is viable even if funds were not deposited in a “special account”.
  • If any guarantee existed, both guaranteed and non-guaranteed amounts may be refundable.

Therefore

Your claim is both viable and sound if the following are met:

  • You are within the statute of limitations (typically up to 15 years from the deposit date).
  • You have a signed reservation or private sale contract and proof of payments (transfers, receipts or cheques).
